Welcome to DockHosting. These Terms of Service ("Terms") govern your access to and use of the DockHosting website, platform, APIs, and associated hosting services (collectively, the "Services").
By checking the "I agree to the Terms of Service" box during registration, or by accessing or using our Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
1. Definitions
- Platform: The DockHosting cloud infrastructure and control plane used for deploying and managing applications and databases.
- Account: The primary user identity used to authenticate and access the Platform.
- Workspace: An operational environment within the Platform where resources are provisioned, which may be owned by an individual or a collaborative team.
2. Account Registration and Security
2.1. Account Verification: You must register an Account to use the Services. You agree to provide accurate and complete information. We reserve the right to verify your identity and suspend accounts utilizing fake, disposable, or fraudulent information.
2.2. Workspace Liability: Every Workspace must have an assigned Owner. The Owner of a Workspace is solely financially and legally responsible for all activities, resource consumption, and content hosted within that Workspace, regardless of which invited team member initiated the action.
2.3. Credential Security: You are strictly responsible for safeguarding your authentication credentials (passwords, SSH keys, API tokens). DockHosting assumes no liability for any loss or damage arising from unauthorized access to your account due to compromised credentials.
3. Billing and Payments
3.1. Fees: You agree to pay all fees associated with the resources provisioned under your Workspaces according to our current pricing schedule.
3.2. Non-Refundable: All payments are processed via authorized third-party gateways. All payments and Point purchases are final and non-refundable, except where strictly required by law.
3.3. Suspension for Non-Payment: If an account falls into arrears, DockHosting reserves the right to immediately suspend all running containers and databases. Suspended resources may be permanently deleted after 7 days of inactivity without further notice.
4. Acceptable Use Policy (AUP)
You agree not to use DockHosting to:
- Host AI/ML Workloads: Deploy, host, train, or run artificial intelligence models, machine learning algorithms, or LLMs on our shared infrastructure.
- Host Malicious Code: Distribute, host, or execute malware, ransomware, or cryptocurrency mining scripts (e.g., CPU/GPU mining).
- Violate Laws: Host illegal content, including material that infringes on intellectual property rights, promotes terrorism, or violates child protection laws.
- Abuse Networks: Conduct network abuse, including DDoS attacks, port scanning, or distributing spam.
- Defraud: Operate phishing sites, fraudulent applications, or attempt to deceive third parties.
DockHosting reserves the right to immediately suspend or terminate any Account violating this AUP, and we may report such violations to the relevant law enforcement authorities.
5. Data Privacy, Security, and Backups
5.1. User Responsibility: You are solely responsible for configuring your applications securely. DockHosting is not liable for data breaches, data loss, or service interruptions resulting from misconfigured application code, leaked SSH keys, weak database passwords, or insecure API design.
5.2. No Guarantee of Backups: While DockHosting may offer automated backup tools, you are solely responsible for maintaining independent backups of all your critical data. We expressly disclaim any liability for data loss or uncorrupted restoration of data.
6. Intellectual Property
You retain all intellectual property rights to the code, data, and content you deploy on DockHosting. You grant us a worldwide, royalty-free, non-exclusive license to host, cache, route, and back up your content strictly as necessary to provide the Services to you.
7. Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and without prior notice. Upon termination, your right to use the Services will immediately cease, and we may delete all data associated with your Account.
8. Force Majeure
DockHosting shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, hardware provider outages (e.g., upstream datacenter failures), cyber-attacks, or government actions.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DOCKHOSTING EXPRESSLY DISCLAIMS ALL WARRANTIES of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, COMPLETELY SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DOCKHOSTING, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY.
IN NO EVENT SHALL DOCKHOSTING'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50.00 USD) OR THE AMOUNT YOU PAID TO DOCKHOSTING IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to defend, indemnify, and hold harmless DockHosting and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from:
(a) your use of and access to the Services;
(b) your violation of any term of these Terms;
(c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
(d) any claim that your content caused damage to a third party.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or dashboard notification. Your continued use of the Services after changes become effective constitutes your binding acceptance of the updated Terms.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Casablanca, Morocco, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
